Please read these terms carefully before using our services. By engaging with Aussie Loan Office, you agree to be bound by these terms and conditions.

1. Introduction

These Terms and Conditions ("Terms") govern your use of the services provided by Aussie Loan Office("we", "us", "our", "the Company"), a licensed pawnbroker operating at 222 Burwood Rd, Burwood, NSW 2134, New South Wales, Australia.

We operate under the Pawnbrokers and Second-hand Dealers Act 1996 (NSW) and are fully licensed and regulated by the relevant New South Wales authorities. Our business registration and license details are available upon request.

By entering into any transaction with us, whether in-store, over the phone, or through any other means, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services Provided

We provide the following services:

  • Pawn Loans: Secured loans against valuable items including jewellery, gold, electronics, tools, musical instruments, and other valuable assets.
  • Gold Trading: Purchase of gold jewellery, gold coins, gold bullion, and scrap gold at fair market prices.
  • Valuations: Free valuations of items for pawn loans or sale purposes.
  • Consultations: Free consultations regarding pawn loans, valuations, and our services.

All services are subject to our assessment of items, verification of identity, and compliance with applicable laws and regulations.

3. Eligibility and Requirements

3.1 Age Requirement

You must be 18 years of age or older to enter into any transaction with us. We reserve the right to request proof of age and identity before processing any transaction.

3.2 Identity Verification

You must provide valid government-issued photo identification (such as a driver's license, passport, or proof of age card) before we can process any transaction. We are required by law to verify your identity and may keep records of identification as required by the Pawnbrokers and Second-hand Dealers Act 1996 (NSW).

3.3 Ownership and Authority

You warrant that:

  • You are the legal owner of any item you offer as collateral or for sale, or you have the express authority of the owner to do so.
  • The item is not stolen, fraudulently obtained, or subject to any liens, charges, or encumbrances.
  • You have full legal capacity to enter into the transaction.

We reserve the right to refuse any transaction if we have reasonable grounds to suspect that an item may be stolen, fraudulently obtained, or if you cannot prove ownership or authority.

4. Pawn Loans

4.1 Loan Agreement

When you enter into a pawn loan agreement with us:

  • You provide an item of value as collateral for a loan.
  • We provide you with cash based on our valuation of the item.
  • You receive a pawn ticket detailing the loan amount, interest rate, fees, and redemption period.
  • The item remains in our secure storage until the loan is repaid in full.

4.2 Valuation

All valuations are conducted by our qualified staff based on:

  • Current market value of the item
  • Condition and authenticity
  • Market demand and resale potential
  • Our assessment criteria

Valuations are provided in good faith but are estimates only. We are not obligated to proceed with a loan if you do not accept our valuation. You are under no obligation to accept our offer.

4.3 Interest Rates and Fees

Interest rates and fees are:

  • Disclosed to you before you enter into the loan agreement
  • Set out clearly on your pawn ticket
  • Compliant with the maximum rates permitted under the Pawnbrokers and Second-hand Dealers Act 1996 (NSW)
  • Calculated and charged in accordance with applicable laws

All interest rates and fees will be explained to you before you sign any agreement. You have the right to ask questions and seek clarification before proceeding.

4.4 Redemption Period

The redemption period for pawn loans is typically 3 months from the date of the loan, unless otherwise agreed in writing. During this period, you may redeem your item by paying:

  • The principal loan amount
  • All accrued interest
  • Any applicable fees

4.5 Extension and Renewal

You may request an extension or renewal of your loan before the redemption period expires. Extensions are subject to:

  • Payment of accrued interest and fees
  • Our agreement to extend
  • Any additional fees for extension

We will work with you to find a solution if you are experiencing difficulties repaying your loan. Contact us as soon as possible to discuss your options.

4.6 Default and Forfeiture

If you fail to redeem your item within the redemption period (including any agreed extensions), and fail to make arrangements with us, the item may become our property. This process is governed by the Pawnbrokers and Second-hand Dealers Act 1996 (NSW).

We will make reasonable efforts to contact you before forfeiture occurs. We are required by law to provide notice before forfeiture in accordance with applicable regulations.

5. Gold Trading and Sales

5.1 Sale Transactions

When you sell items to us:

  • The sale is final once payment is made and you have signed the sale agreement
  • We purchase items at fair market prices based on current market conditions
  • Payment is made in cash on the same day, subject to verification and processing
  • All sales are subject to our verification of authenticity and value

5.2 Pricing

Prices offered for gold and other items are based on:

  • Current market prices for precious metals
  • Purity and weight of gold items
  • Condition and authenticity
  • Market demand

Prices may fluctuate based on market conditions. We provide free valuations before purchase, and you are under no obligation to sell.

6. Item Storage and Security

6.1 Secure Storage

All items held as collateral are stored in secure, insured facilities. We take reasonable care to protect items in our possession, but you acknowledge that:

  • Items are stored at your risk
  • We maintain appropriate insurance coverage
  • We are not liable for loss or damage due to circumstances beyond our reasonable control

6.2 Inspection

You have the right to inspect your item during business hours, by appointment, provided you produce your pawn ticket and valid identification. We reserve the right to charge a reasonable fee for inspection if the item is not redeemed.

7. Limitation of Liability

7.1 General

To the maximum extent permitted by law:

  • Our liability is limited to the amount of the loan or purchase price paid
  • We are not liable for indirect, consequential, or special damages
  • We are not liable for loss or damage due to circumstances beyond our reasonable control
  • All warranties, express or implied, are excluded except as required by law

7.2 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified.

8. Privacy and Data Protection

We are committed to protecting your privacy. Our collection, use, and disclosure of personal information is governed by our Privacy Policy and the Privacy Act 1988 (Cth). By using our services, you consent to our collection and use of your personal information as described in our Privacy Policy.

We are required by law to collect certain information, including identification details, and may be required to report transactions to relevant authorities as required by the Pawnbrokers and Second-hand Dealers Act 1996 (NSW) and other applicable laws.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.

These Terms are subject to:

  • Pawnbrokers and Second-hand Dealers Act 1996 (NSW)
  • Privacy Act 1988 (Cth)
  • Australian Consumer Law
  • Other applicable Commonwealth and State laws

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or as otherwise notified. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

For existing loan agreements, the terms in effect at the time of the loan will continue to apply unless otherwise required by law.
